Compusoar strives to provide the best possible web hosting experience to many customers. We have a responsibility to protect each client, and ourselves,
against any unlawful activity or abuse of our servers. The following guidelines were established to ensure these obligations are met.
Compusoar reserves the right to modify, update, change, or revise this Policy, at its sole discretion, without notice. Unless otherwise noted, any
modifications, updates, changes or revisions become effective upon their posting.
Content Policy:
All services provided by Compusoar may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States
Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material
protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Compusoar from any claims resulting from the use of the service
that damages the subscriber or any other party. Pornography and sex-related merchandising is prohibited on all Compusoar servers. This includes sites that may infer sexual content, or links
to adult content elsewhere. Child Pornography of any kind is prohibited and will be reported to the proper authorities if found. Compusoar will be the sole arbiter in determining
violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to Compusoar's servers or any other server on the Internet.
Links to such materials are also prohibited.

Examples of Unacceptable Content or Links:
- Pirated software
- Hacker programs or archives
- Warez sites
Compusoar does not host sites of its competitors, or web pages promoting sites of its competitors. Any illegal activity, including adult content, links to
adult content web sites, spamming or hacking will result in your site being shut down and all your files deleted without warning. Compusoar will be the sole arbiter as to what constitutes a
violation of this provision.
Scripts:
Any Script that adversely affects any part of the network is forbidden.

CGI Scripts Policy:
If your account has cgi script capabilities, you are free to use any CGI scripts you wish, as long as they are not on our banned script list. We do reserve the right to disable any CGI script that affects normal server operation or
service to other Compusoar customers. We will attempt to notify you by means of an email sent to the primary email address on file within 24 hours of disabling the offending script.
Compusoar is not responsible for scripts that you use in your hosting, including any scripts offered in our packages. It is not our responsibility to ensure your scripts function. Please
don't expect our support techs to troubleshoot aspects of your scripts or third party scripts that you use on your sites hosted on our servers.

Traffic Policy:
Compusoar allows for very generous traffic. Site Owners are discouraged from storing any files that cause excessive traffic on our network. Please contact Compusoar for further
information or clarification. Any deliberate attempt to cause damage to Compusoar's network, or any other Internet servers, will result in immediate account deactivation without prior notice.
No refund will be given in this case. All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $5.00 for each GB of traffic exceeded. You will NOT be
charged for transfer that you use beyond our generous data transfer limits without prior notification. You can monitor your transfer at anytime in your Control Panel.

Anti-Spam Policy:
Compusoar is committed to a zero-tolerance, anti-Spamming policy Client shall not use, nor recklessly or knowingly permit others to use, any part of the network to send unsolicited messages
of any kind, regardless of the content or nature of such messages, including but not limited to email, newsgroup postings and web forum postings. Account Holder shall also not promote, nor recklessly
or knowingly permit others to promote, any product or service that uses any part of the network by means of unsolicited messages of any kind, regardless of the content or nature of such messages.
Using an email address or domain that is maintained on an Compusoar server as a reference is STRICTLY prohibited

Mailing Lists:
All mailing lists must use only a confirmed opt-in process for adding subscribers. All subscription based lists must have unsubscribe procedures that are simple to locate and complete. If your
mailing list exceeds 1000 addresses, you must first contact Compusoar requesting and receiving permission to send through the network prior to each mailing.

Server Abuse Policy:
When an account's resources exceed the amount allocated, we will notify the Account Holder by means of an email sent to the primary email address on file and, depending on the severity, will either:
Charge the account for the extra usage, immediately suspend the account allowing the site owner to rectify the situation to our satisfaction, or immediately terminate the account, including
termination of this agreement without further liability or obligation to account holder.

Backups:
Full backups are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the
client's responsibility to maintain local copies of their web content any information. The "Backup Manager" is included in each hosting plan and the client can use this tool to back up their files.
If loss of data occurs due to an error of Compusoar, we will attempt to recover the date for no charge to the client. If data loss occurs due to negligence of client in securing their
account or by an action of the client, Compusoar will attempt to recover the data from the most recent archive for a fee.

Conformance with the Policies of Others:
Clients are bound by the terms of Compusoar's upstream providers.
Payment and Termination:
In consideration of the performance of the Services, Client shall pay Compusoar monthly in advance the amount set forth in Compusoar’s customer database as such records are amended from time to time for the Services during the term of this Agreement.
All payments are due on time. Failure to use the services associated with a package will not relieve the Account Holder of payment obligations for such services.
Compusoar may terminate service when client's payment is late and shall not be responsible for maintaining any data client may have uploaded to Compusoar's server. Compusoar reserves the right to suspend the client's services after 7 days if payment is not received or no other arrangement has been made.
Upon account suspension, Compusoar is not responsible in any way for client's data. Compusoar reserves the right to require a re-activation fee of $35.00. Exceptions may be made at Compusoar's discretion, if Compusoar is notified IN ADVANCE of any late payments.
Accounts terminated
due to a violation will deleted immediately and without backup provisions. Compusoar reserves the right to change prices at any time.

Indemnification:
The client and his agents agree to defend, indemnify and hold harmless Compusoar and its affiliates against any and all losses, liabilities, expenses and damages of every kind and nature,
including all legal fees and costs, arising out of
- Any injury to person or property caused by any products sold or otherwise distributed in connection with Compusoar's server;
- Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
- Copyright infringement
- Any defective products sold to customer from Compusoar's server.

Disclaimer of Warranties:
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
A. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Compusoar EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR
IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
B. Compusoar MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE
OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL
MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
C. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM
OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
D. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Compusoar OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

Limitation of Liability:
YOU EXPRESSLY UNDERSTAND AND AGREE THAT Compusoar SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO,
DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF Compusoar HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:
A. THE USE OR THE INABILITY TO USE THE SERVICE;
B. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR
FROM THE SERVICE;
C. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
D. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR
E. ANY OTHER MATTER RELATING TO THE SERVICE. EXCLUSIONS AND LIMITATIONS SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL
OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
